- "Platform" means the ODC digital platform, including the website, mobile applications, and any associated tools or services.
- "User" means any individual or entity that accesses or uses the Platform, including owner drivers, fleet operators, and industry participants.
- "Services" means all services provided by ODC through the Platform, including but not limited to compliance management, safety tools, electronic work diaries, and industry resources.
- "Content" means any information, data, text, images, or other materials uploaded, submitted, or displayed on the Platform.
2. Eligibility
To use our Services, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into a binding agreement
- Provide accurate and complete registration information
- Hold any licences or permits required for your role in the transport industry (where applicable)
3. Account Registration
When you create an account with us, you agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorised use of your account
We reserve the right to suspend or terminate accounts that contain inaccurate information or violate these terms.
4. Use of Services
4.1 Permitted Use
You may use our Services only for lawful purposes and in accordance with these Terms. You agree to use the Platform in a manner consistent with its intended purpose of supporting owner drivers and the transport industry.
4.2 Prohibited Conduct
You must not:
- Use the Services for any unlawful or fraudulent purpose
- Interfere with or disrupt the Platform or its infrastructure
- Attempt to gain unauthorised access to any part of the Platform
- Upload or transmit viruses, malware, or other harmful code
- Scrape, harvest, or collect data from the Platform without authorisation
- Impersonate any person or entity, or misrepresent your affiliation
- Use the Services in a way that could damage, disable, or impair the Platform
5. Intellectual Property
All content, features, and functionality on the Platform — including but not limited to text, graphics, logos, icons, images, software, and design — are owned by or licensed to ODC and are protected by Australian and international intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any of our intellectual property without prior written consent.
6. User Content
By submitting Content to the Platform, you:
- Retain ownership of your Content
- Grant ODC a non-exclusive, royalty-free, worldwide licence to use, display, and distribute your Content in connection with the Services
- Represent that you have the right to submit such Content and that it does not infringe any third-party rights
We reserve the right to remove any Content that violates these Terms or that we deem inappropriate.
7. Privacy
Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Services, you consent to the practices described in the Privacy Policy.
8. Fees and Payment
- Certain features of the Platform may require payment of fees
- All fees are quoted in Australian Dollars (AUD) and are inclusive of GST unless otherwise stated
- We reserve the right to change our fees at any time, with reasonable notice provided to affected Users
- Failure to pay applicable fees may result in suspension or termination of your access to paid features
9. Disclaimer of Warranties
The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by Australian law, ODC disclaims all warranties, express or implied, including but not limited to:
- Merchantability and fitness for a particular purpose
- That the Services will be uninterrupted, secure, or error-free
- The accuracy or reliability of any information obtained through the Services
Nothing in these Terms excludes or limits any consumer guarantees under the Australian Consumer Law that cannot be excluded or limited by law.
10. Limitation of Liability
To the maximum extent permitted by law, ODC and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Services.
Our total liability to you for any claim arising from these Terms or the Services shall not exceed the total fees paid by you to ODC in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless ODC, its directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising out of:
- Your use of the Services
- Your violation of these Terms
- Your violation of any third-party rights
- Any Content you submit to the Platform
12. Termination
We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination:
- Your right to use the Services will immediately cease
- We may delete your account and associated data, subject to our data retention obligations
- Provisions of these Terms that by their nature should survive termination will remain in effect

These Terms are governed by the laws of the State of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of Victoria for the resolution of any disputes arising from these Terms or the Services.
